Constructive Eviction

Landlords have a duty to make repairs to the property in a reasonable amount of time. They must also keep the property livable (duty of habitability). If you were forced to leave your home because of a condition on the property, you may have a right to sue your landlord for constructive eviction. You can also bring a lawsuit if your landlord's actions forced you to leave the premises. For example, if your landlord harassed you to the point that you had to leave, you may have been wrongfully evicted.

Wrongful Eviction

In some circumstances, tenants can show that their landlord unlawfully evicted them from the property. You may have been wrongfully evicted if:

  • The landlord gave you inadequate warning of an eviction. Landlords must provide written notice of an eviction with a valid reason for the eviction.
  • The landlord evicted you to take control of the apartment for his or her own purposes (such as kicking you out to rent to someone else at a higher price).
  • The landlord entered your home without your consent and evicted you because of something that he or she found on the property.
  • The landlord discriminated against you. Under the Fair Housing Act, if you were treated unfairly because of your race, gender, sexual orientation, religious beliefs, disability or ethnic background, you have a claim against your landlord.

Alternatives to Eviction

Tenants may be evicted for many reasons, including failure to pay rent, violation of the lease terms, property damage and criminal activity on the premises. If you received a valid eviction notice, I can discuss possible alternatives to eviction with you.
